1. ELIGIBILITY: This Sunrun’ Weber Lumin Electric Grill Sweepstakes (the “Promotion”) is open only to legal residents of the District of Columbia and the 50 United States who are 18 years of age and older as of July 4, 2023. Employees of Sponsor (defined below) and its affiliates, subsidiaries, and related companies, agencies, and immediate families (defined as parents, children, siblings and spouse and their respective spouses, regardless of where they reside) and those living in the same household, whether or not related, are not eligible to enter or win. This Promotion is subject to all applicable federal, state, and local laws and regulations and is void where prohibited.
2. SPONSOR AND ADMINISTRATOR: The Sponsor and administrator of this Promotion is Sunrun Inc., 225 Bush Street, #1400, San Francisco, CA 94104 (the “Sponsor”).
3. AGREEMENT TO OFFICIAL RULES: Participation in this Promotion constitutes entrant’s full and unconditional agreement to these Official Rules and the Sponsor’s decisions, which are final and binding in all matters related to this Promotion. Winning a Prize is contingent upon fulfilling all requirements set forth herein and winners are subject to the Official Rules of this Promotion. In the event that any winner is found to be in violation of these Official Rules or is otherwise determined by either the Sponsor in its sole discretion to be ineligible, he/she may be required to forfeit the Prize or to reimburse the Sponsor for the stated value of a Prize if such a violation is found after costs have been incurred on behalf of a winner.
4. HOW TO ENTER: Beginning on July 4, 2023, at 12:01 a.m. Eastern Time through July 6, 2023, at 11:59p.m. Eastern Time (the “Promotion Period”), participants (each, an “Entrant”) may enter the Promotion by 1) liking the “Weber Lumin Electric Grill Sweepstakes” post, dated July 4, 2023 (the “July 4th Post”), on the SunrunSolar Instagram account, 2) following the SunrunSolar Instagram account and 3) sharing the July 4th Post on the Entrant’s Instagram account’s stories. Each Entrant may enter only once per household. Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. Each Entrant may not enter more times than indicated by using multiple Instagram accounts, email addresses, identities, or devices in an attempt to circumvent the rules. By entering, Entrants give their express permission to be contacted by Sponsor by phone, social media, mail, or email.
5. PRIZE DETAILS: A total of ten (10) Prizes will be awarded. The Prize is one (1) Weber Lumin electric grill (the “Prize”) with a retail value of approximately four hundred fifty U.S. Dollars ($450). Any difference between stated approximate retail value and actual value will not be awarded. The Prize consists of only those items specifically listed as part of the Prize. Limit one Prize per family or household. No substitution, assignment, or transfer of the Prize to others, or requests for the cash equivalent by the Winner is permitted. Sponsor reserves the right to substitute a Prize of equal or greater value. All Prizes will be awarded. If a potential winner is disqualified for any reason, Sponsor will award the applicable Prize to an alternate winner by random drawing from among all remaining eligible entries.
6. WINNER SELECTION: Sponsor will conduct a random drawing on or about July 7, 2023, by Sponsor to select the ten (10) Winners from among all eligible entries received during the Promotion Period. The odds of being selected as a potential Winner depend on the number of entries received during the Promotion Period. Potential winners will be notified by direct message (“DM”) on Instagram and must confirm receipt within five (5) days of the date notice is sent or such other date set by Sponsor. Failure to respond within the applicable time period will result in forfeiture of the Prize and Sponsor shall have the option to award the Prize to an alternate winner. If the holder of a social media account is disputed, entry will be deemed made by the natural person who is assigned to the social media account by the internet access provider, online service provider or other organization (e.g., business, school, etc.) that assigns social media addresses for the domain associated with the social media account. The return of any Prize notification or Prize as undeliverable may result in disqualification and an alternate Winner may be selected. Any and all Prize related expenses, including without limitation any and all federal, state, and/or local taxes, are the sole responsibility of Winner. The Winner of any Prize above the IRS threshold, currently $600, will be required to complete an IRS Form W-9, which requires disclosure of Winner’s social security number, and an IRS Form 1099 reflecting the value of the Prize will be issued to the Winner as required by law. Acceptance of a Prize also constitutes permission to the Sponsor to post the winner's Instagram account to the Sponsor’s Instagram account without further compensation or right of approval, unless prohibited by law. All federal and state laws apply. If, as a result of an error relating to the entry process, drawing or any other aspect of the Promotion, there are more Entrants selected as potential Winners than contemplated in these Official Rules, there will be a random draw among all eligible Prize claimants after the Promotion's closing date to award the correct number of Prizes. POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISION IS FINAL. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE PROMOTION SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT'S ELIGIBILITY AND THE POTENTIAL WINNING ENTRY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS.
7. RELEASE, INDEMNIFICATION, AND LIMITATION OF LIABILITY: By entering this Promotion, each Entrant hereby releases, waives all right to, indemnifies, and holds the Sponsor and its parents, affiliates, and subsidiaries, harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys' fees) arising out of or in connection with participation in this Promotion or the acceptance, use, or misuse of any Prize. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Sponsor will not be responsible for: late, incomplete, or incorrect entries; an entrant's failure to receive Prize notices due to entrant's spam, junk e-mail, or other security settings or for entrants' provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this Promotion; by any human error which may occur in the processing of the entries in this Promotion; or any typographical, technological, or other error in the publishing of the offer, administration of the Promotion, or announcement of the Prizes. If, in the Sponsor’s opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the Promotion, or if technical difficulties (including viruses and bugs) compromise the integrity of the Promotion, Sponsor reserves the right to cancel or modify this Promotion in a manner deemed appropriate by the Sponsor. In the event of termination, winners will be selected from among all eligible entries received as of date of termination. In the event a dispute arises as to the identity of a potentially winning entrant, entries will be declared made by the name on the online entry form.
8. GENERAL CONDITIONS: Except where legally prohibited, the Entrant grants (and will confirm that grant in writing) permission to Sponsor and its affiliates, exercised in their sole discretion, the right to use the Entrant’s name, city, state, Entry and/or Prize information in connection with the Promotion for promotional, advertising or other purposes, worldwide, in any and all media now known or hereafter devised, without limitation and without further payment, notification, permission or other consideration and without notice, review, or approval. By entering, each Entrant warrants that the Entrant has followed the Rules and has the right to grant the rights to a content as provided in these Rules. In the event Sponsor is prevented from continuing with this Promotion, or the integrity and/or feasibility of the Promotion is undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute, or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state, provincial or local government law, order of regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor's control (each a "Force Majeure" event) Sponsor shall have the right, in their sole discretion, to abbreviate, modify, suspend, cancel or terminate the Promotion without notice or further obligation. If Sponsor, in their discretion, elects to abbreviate, cancel or terminate the Promotion as a result of a Force Majeure event, Sponsor reserves the right, but shall have no obligation, to award the Prize to valid and eligible entries received up to the time of such Force Majeure event. Sponsor reserves the right to correct typographic, clerical or printing errors in any Promotion materials. Sponsor is not responsible for any typographical or other error in the printing of this Promotion, the administration of the Promotion or in the announcement of a Prize, including such error as may give an erroneous indication that a Prize has been won.
9. CHOICE OF LAW AND FORUM: Entrant agrees that all matters arising out of or relating to this Promotion and these Official Rules are governed by, and construed in accordance with, the laws of California, without giving effect to any of its conflict of laws provisions thereof. Entrant further agrees that any legal suit, action, or proceeding arising out of or relating to this Promotion and these Official Rules shall be brought exclusively in the applicable federal or state courts located in San Francisco, California.
10. PRIVACY: Information submitted with an entry is subject to the Privacy Policy stated on https://www.sunrun.com/privacy-policy.
11. WINNERS LIST: For the names of all Prize winners, available after July 31, 2023, send a self-addressed, stamped #10 envelope to: Sunrun Inc., 225 Bush St., Suite 1400, San Francisco, CA 94104.
